GoCard Digital Business Card Service Terms and Conditions
1. Acceptance of Terms
By registering for and using GCSB's GoCard Digital Business Card Service
(the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
2. Definitions
A. GCSB: Refers to [GOCARD Sdn Bhd].
B. GoCard: Refers to the Digital Business Card Service provided by GCSB.
3. Registration and Accounts
A. Account Creation: To use GoCard, users must create an account with accurate and complete information. Users are responsible for maintaining the confidentiality of their account credentials.
B. Account Security: Users must promptly notify GCSB of any unauthorized use of their account or any other security breach.
4. Personal Data Collection and Use
A. Consent: By using GoCard, users consent to the collection, use, and disclosure of personal information as outlined in these Terms and Conditions.
B. Information Collected: GCSB may collect personal information for the purpose of providing the Service, enhancing user experience, and improving our business.
C. Marketing: Users may receive marketing communications from GCSB. Opt-out options are provided, and users can manage their communication preferences.
5. Subscription Tiers and Pricing
A. Free Basic Tier: The Free Tier provides basic access to GoCard with limited features. (Official discontinuation will occur on August 28, 2024. Existing users on the Free Plan can renew every 30 days until December 31, 2024, after which they are encouraged to upgrade to our Advance Plan.)
B. Advance Tier (RM108.00): The Advance Tier offers enhanced features and services for a subscription fee of RM108.00 for a 365-day period.
C. Professional Tier (RM540.00): The Professional Tier includes premium features and priority support for a subscription fee of RM540.00 for a 365-day period.
6. Payment and Refund Policy
A. Payment: Subscription fees are payable in advance. Payment methods and details will be provided during the subscription process.
B. Refunds: Subscription fees are non-refundable. GCSB may, at its discretion, consider refunds in exceptional circumstances.
7. Data Security and Privacy
A. Security Measures: GCSB implements industry-standard security measures to protect user data from unauthorized access, disclosure, alteration, and destruction.
B. User Responsibility: Users are responsible for maintaining the confidentiality of their account information.
8. PDPA Compliance
A. PDPA Compliance: GCSB adheres to the requirements of the Personal Data Protection Act (PDPA) of Malaysia. Personal information is handled in accordance with the PDPA.
B. Access and Correction: Users have the right to access, correct, and update their personal information.
9. Intellectual Property
A. Ownership: GCSB retains all rights, title, and interest in and to GoCard, including all intellectual property rights.
B. License: Users are granted a limited, non-exclusive, non-transferable license to use GoCard for its intended purpose.
10. Limitation of Liability
A. No Warranty: GCSB provides GoCard "as is" without any warranty. Users acknowledge and agree that they use the Service at their own risk.
B. Limitation of Liability: GCSB shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
11. Termination
GCSB reserves the right to terminate or suspend user access to GoCard at any time, with or without cause.
12. Changes to Terms and Conditions
GCSB reserves the right to modify or update these Terms and Conditions at any time. Users will be notified of significant changes.
13. Downtime and Service Interruptions
A. Scheduled Maintenance: GCSB may schedule maintenance that could result in temporary unavailability of the Service. Reasonable efforts will be made to notify users in advance.
B. Emergency Downtime: In the event of emergencies, GCSB reserves the right to temporarily suspend the Service without prior notice.
14. Takedown Requests and Abuse Prevention
A. Takedown Requests: GCSB will investigate and respond to legitimate takedown requests for content that violates applicable laws or these Terms and Conditions.
B. Abuse Prevention: Users engaging in abusive behavior, including but not limited to spam, harassment, or violation of intellectual property rights, may face account suspension or termination.
15. Governing Law and Dispute Resolution
A. Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.
B. Dispute Resolution: Any disputes arising from or relating to these Terms and Conditions will be resolved through arbitration in accordance with the laws of Malaysia.
16. User-Provided Information and Accuracy
A. User Responsibility: Users are solely responsible for the accuracy, completeness, and legality of the information they provide while using GoCard.
B. False Information: GCSB disclaims any responsibility for false, inaccurate, or misleading information provided by users. GCSB does not verify the accuracy of user-provided content and shall not be held liable for any consequences arising from reliance on such information.
C. Verification: While GCSB may implement measures to verify user identity or information, it does not guarantee the accuracy of user-provided data.
D. Reporting False Information: Users are encouraged to report any instances of false or misleading information through the appropriate channels provided by GCSB. GCSB reserves the right to take appropriate action, including but not limited to the removal of content and suspension of user accounts.
17. Data Collection for Service Improvement and Marketing
A. Purpose of Data Collection: By using GoCard, users acknowledge that GCSB collects personal information for the purposes of providing, improving, and personalizing the Service. This includes, but is not limited to, analyzing user behavior, preferences, and trends for service enhancement.
B. Marketing Communications: Users agree to receive marketing communications from GCSB, which may include newsletters, promotional offers, and updates related to GoCard. Users can opt-out of these communications at any time through the provided mechanisms.
C. Third-Party Marketing: GCSB may collaborate with third-party partners for marketing initiatives. In such cases, user data may be shared in accordance with applicable laws and GCSB's Privacy Policy.
D. Service Improvement: Aggregated and anonymized user data may be used for internal analysis and service improvement. GCSB will take measures to ensure that individual users cannot be identified from such data.
E. Opt-Out Options: Users who do not wish to participate in data collection for marketing purposes or service improvement can manage their preferences through the account settings or by contacting GCSB's customer support.
F. Consent: By using GoCard, users provide explicit consent to the collection and use of their personal information for the stated purposes in this section.
18. Entire Agreement
These Terms and Conditions constitute the entire agreement between users and GCSB regarding GoCard, superseding any prior agreements.
